The United States of America (US) does not necessarily promote an immigration program which invites individuals to the US, but rather has an immigration policy which is strictly enforced, and more so particularly since the dreadful events of 9/11 which changed world travel and migration forever.
Certainly, there are posts in the US which will afford newcomers the necessary visas and smooth entry, but these are open only to applicants with exceptional academic qualifications and experience.
Nevertheless, there is a sophisticated immigration program which attempts to monitor and screen all applicants wishing to enter the country, and in most cases the entry criteria is stringent and set at a high level.
It should be made quite clear from the outset that initial entry to the US is made on a temporary basis, and the applicant is referred to as an Alien, and many restrictions apply to temporary visas where families are concerned.
This information is not published with the intention of being derogatory, or as a put-off for aspirant migrants, but merely as a factual appraisal of the immigration requirements in the US.
There are many visa possibilities for newcomers to the US, and we will deal with those most likely to be applicable to our website visitors.
Non-Immigrant Visas: A number of visas are available for initial entry to the US and we list those most popular:
- B-1: The “ Business Visitor” Probably the most widely applied-for visa which allows the bearer access to the US for purposes of travel and business. Applications for the B-1 however have been affected recently by closer scrutiny of individuals, and tougher requirements at application stage. The visa is issued based on the merits and background of the applicant, and allows those individuals to conduct business, sign contracts, acquire property , but specifically precludes those individuals from earning remuneration in any form in the US.
- L-1: Intra-company Transferee. Available to employees of US multi-nationals requiring transfer to US based operations or to business individuals seeking to establish a business entity in the US subject to specific conditions. This is probably the least problematic visa to obtain provided that the applicant can meet the monetary and immigration conditions
- E-1: Treaty Trader Visa. This visa is available to applicants from countries which are party to a treaty of trade and commerce with the US. It is mostly applied for by small to medium-size enterprises looking to establish on-going business links in the US.
- E-2: Treaty Investor The same basic requirements apply as for the E-1, but in this instance individuals can invest in US corporations or businesses and stay permanently in the US.
- H-1B: Temporary Professional Worker. The basic requirement is that the applicant hold a 4 year Bachelor Degree, with US credential evaluation, in addition to an offer of employment from a US employer, who will become the Sponsor. There is an onus on the sponsor to comply with certain regulatory requirements in order for the applicant to gain entry to the US. Validity of the visa is for a maximum of 6 years and can lead to Permanent Residence.
- O-Visa: The essential ingredient of the applicant’s credentials will be “extraordinary” ability in their chosen field of endeavour, education, arts, science and technology or any other pursuit which could be considered beneficial to the US. The applicant would be required to have reached the pinnacle of their careers and achieved recognition for their efforts in their chosen fields. There are many other factors applied in terms of recognition and individuals are urged to seek advice in this regard.
- P-Visa: This visa is similar to the O-visa but is intended for athletes or performers who do not necessarily meet the stringent requirements of the O-visa, but who can demonstrate that they have the ability to compete individually or as part of a recognized team in specific events or performances, that has received recognition as special or outstanding over a sustained period of time.
