For this purpose there are various testing authorities worldwide that can determine your level of proficiency. The best known of these is IELTS and you are advised to ensure that your English is of an acceptable standard to warrant selection.

AUSTRALIAN IMMIGRATION:

Immigration policy and regulation is designed to address the demand for skilled and professional individuals as well as business people, required for economic, strategic and social expansion. Australia is also cognizant of the unification of the family unit and provides residence through a number of migration options.

The information concerning the different categories of visas is seemingly endless, and requires much definition. It is due to this that counselling and correct advice is essential in you being equipped with the facts in order to make an informed decision.

We have concentrated on those aspects of residence in Australia which we consider being of general interest, but can advise accordingly on any type of situation or circumstances.

GENERAL SKILLED MIGRATION: Comprises of Independent Migration and Family or State/Territory Sponsored Migration.

PERMANENT RESIDENCE

  • SKILLED INDEPENDENT

You must pass the points test and satisfy the basic requirements of age, work experience, tertiary qualifications and English proficiency

  • SKILLED SPONSORED

You must pass the points test and satisfy the basic requirements of age, work experience, tertiary qualifications and English proficiency. You must also be sponsored by a State/Territory Government or sponsored by an eligible Australian relative.

  • SKILLS MATCHING DATABASE

This category is not points tested, but rather for those applicants who feel that they will not pass the points test but who will satisfy the basic requirements for Age; English language; and Skill. You must however satisfy the requirement of having worked in a skilled occupation for at least 6 months in the past 12 months prior to applying. PROVISIONAL RESIDENCE

  • SKILLED REGIONAL SPONSORED

You must pass the points test (lower pass mark than permanent resident visas) and a lower level of English proficiency required. You must be sponsored by an Australian relative residing in a regional area of Australia or you have been nominated by a participating State/Territory Government. You will be granted “provisional residence” and when certain visa conditions are met you may apply for Permanent Residence. EMPLOYER SPONSORED MIGRATION

  • EMPLOYER NOMINATION SCHEME (ENS)

The Employer Nomination Scheme allows Australian employers to sponsor workers from overseas, or who are currently in Australia, for Permanent Residence, to fill skilled, full time vacancies in their business. This visa is not points tested. You need to satisfy the basic requirements of age, skill, work experience and English proficiency.

  • REGIONAL SPONSORED MIGRATION SCHEME (RSMS).

The Regional Sponsored Migration Scheme allows Australian employers in regional and low population growth areas of Australia to sponsor workers for permanent residence in order to fill skilled vacancies in their business. This visa is not points tested. You need to satisfy the basic requirements of age, skill, work experience and English proficiency. You must be nominated by an employer in a regional area who meets the basic requirements as specified by the Australian Immigration Government (DIAC).

BUSINESS SKILLS MIGRATION:

In March 2003 a revised business migration scheme was introduced, which essentially provides for the granting of provisional visas in the various categories with the exception of the Business Talent Visa which allows permanent residence to the holder. In the case of all other business visas, permanent residence will only be granted upon achieving prescribed objectives after a period of time, and the applicant having been resident in his/her nominated State in Australia. The requirements for each of the following categories are fairly extensive and will require careful explanation depending on the results of the assessment carried out by our consultant.

  • Business Owner (Provisional)
  • State/Territory Sponsored Business Owner (Provisional)
  • Senior Executive (Provisional)
  • State/Territory Sponsored Senior Executive (Provisional)
  • Investor (Provisional)
  • State/Territory Sponsored Investor (Provisional)
  • Business Talent – Permanent Residence

When the prescribed conditions have been met in terms of the provisional categories the applicant may then apply for permanent residence in the respective category, having complied with additional requirements set out for each category of visa, and again we stress the extensive content of information pertaining to these requirements, which will be discussed at length with you depending on your particular circumstances.

In addition to the various categories of visa described briefly above, there are a number of other visa types which may apply in your specific circumstances, and depending on how you are assessed, one or more of the following may be relevant to your requirements:

  • Family Migration: There are a number of visas available in this category for applicants sponsored by close relatives who are Citizens or Permanent Residents of Australia, and include: Parent; Contributory Parent; Spouse; Child; Last Remaining Relative; Special Needs Relative and Dependent Relative.  
  • Resident Return Visa: When you are granted Permanent Residence the visa is valid for 5 years, during which time you can apply for Citizenship if you have resided in Australia for 5 years or more. However if you do not wish to take up the option of Citizenship you can apply for a resident return visa, provided you have met the two year requirement of residence, and this grant will be valid for a further 5 years or 3 months depending on your particular circumstances.
  • Temporary Residence Visa: There are numerous types of visa under the Temporary category and in our objective of maintaining simplicity we highlight only those which we consider to be of interest at this time.  
  • Retirement Visa: Basic requirements are that the applicant has assets of A$750,000 or more if they have children who are resident and A$500,000 if you intend to reside outside of the metropolitan areas of Australia in addition to meeting health and character requirements. You will also have to provide evidence of membership to private health care insurance. Validity of the visa is 4 years and renewable for 2 years at a time thereafter. You will be permitted to work up to 20 hours per week.
  • Working Holiday Visa: Residents of selected Commonwealth countries who are aged between 18 and 30 years are eligible for this visa. Validity is for 12 months with 6 month working stints between individual employers. You will be permitted to study for up to 4 months.  
  • Long Stay Temporary Business Visa: Known as the 457 Visa it is available through Australian employers who wish sponsor a candidate for up to 4 years and having suitably demonstrated compliance with prescribed requirements.
